VARIABLES

1.1 The Competition is open to Australian and international residents.

WHO MAY ENTER

The only persons who may enter into the competition and be awarded prizes are those people specified in Condition 1.1 and who are not (i) employees of, or contractors to, the Promoter(s) or any of its agencies involved with this competition; or (ii) members of the immediate family of such employees and contractors, including any spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the employee or /contractor.

HOW TO ENTER

To enter the promotion, an entrant needs to (1) enter the required details into the registration entry form, (2) agree to receive marketing communications from Nine Lives Bazaar; which are the terms and conditions of entry and submit entry into the draw.

Entries are deemed to be received at the time of receipt into the Promoter’s database. The Promoter is not responsible for receipt of incorrect, inaccurate, or incomplete information caused by an entrant or occurring during transmission. The Promoter is not responsible for any problems or technical malfunction.

LIMITATIONS ON ENTRY

One entry allowed per person (identified by email). Multiple entries per household are allowed. Persons wishing to enter must comply with condition 1.1.

DURATION

The competition commences at the time specified in Condition 1.2 on the date specified in Condition 1.3. Entries must be received by the time specified in Condition 1.4 on the date specified in Condition 1.5.

SELECTION OF WINNER

There will be one (1) winner drawn for the one (1) available prize draws. The total entrant database at the time specified in condition 1.6 on the date specified in condition 1.7, and will be conducted at the location specified in condition 1.8. The first valid entry as per condition 1.1 drawn will win the prize. The “Win A Wardrobe, from us” competition is a game of chance. The Promoter reserves the right to verify the validity of entries at any time during or after the promotional period and reserves the right to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. To the extent permitted by law, the Promoter is not responsible or liable for: (a.) inaccurate / incorrect transcription of entry information; (b.) purported entries that are not received for any reason, including because they were incorrectly uploaded or misdirected, or that are received, but are late, illegible, incomplete, or sent other than as directed in the entry instructions; (c.) unauthorised human intervention in any part of the competition; (d.) electronic or human error which may occur in the administration of the competition; (e.) any loss suffered or sustained, to person or property and including, but not limited to, consequential (including economic) loss by reason of any act or omission, deliberate or negligent, by the Promoter, or its servants or agents, in connection with the arrangement for supply, or the supply, of any goods or services by any person to a prize winner and, where applicable, to any family/persons accompanying a winner; or (f.) any technical difficulties or equipment malfunction (whether or not under either Promoter’s control); (g.) any theft, unauthorised access or third party interference. Promoter’s decision is final and no correspondence will be entered into.

WINNER NOTIFICATION, PUBLICATION AND REDRAW

The winner will be notified via email within 1 hour of the draw. The winner will be contacted via the email address which was entered into the competition landing page entry form. Despite the Promoter’s best efforts to contact the prize winner or deliver a prize, if the prize remains unclaimed by 12pm AEST Monday 19th June 2023 then, subject to any written directions given by a relevant lotteries or gaming authority the Promoter may conduct an unclaimed prize draw at the same time and place as the original prize draw on that date to distribute the unclaimed prize. The first valid entry drawn will win the unclaimed prize. The winner of the unclaimed prize draw will be notified by email within 1 hour of the re-draw.

PRIVACY AND COPYRIGHT

By entering the competition, the prize winner agrees to the use of their name, image, videography and photograph/s for publicity and promotional purposes, without compensation, as the promoters see fit.

By entering the promotion the entrant consents to receive marketing emails from Nine Lives Bazaar. Participants will have the option to unsubscribe to communications should they choose at any point.

DISCLAIMER AND INDEMNITY

To the extent permitted at law, the Company and its related entities, officers, employees, contractors and agents disclaim any liability of any kind (including in contract, tort and breach of statutory duty) for loss, personal injury, death, property damage or otherwise that you may suffer yourself or cause to other persons or property as a result of any activities related to the prize that you undertake or commence, whether inspired by the Promoter or its related entities, officers, employees, contractors and agents, or otherwise. The prize winner and his/her guests acknowledge their personal responsibility and knowingly and willingly assume the risks associated with any activities related to the prize. The Promoter does not condone or encourage in any way the consumption of alcohol or use of illicit narcotics. The prize winner agrees to indemnify, defend and hold harmless the Promoter and its related entities and officers for any and all claims, demands, suits, loss, damage, injury, and liability, including costs, expenses, and reasonable solicitors fees arising from, or in any way connected with, the prize. Subject to the approval process required by any relevant gaming or lotteries authority, in the event that any prize item is unavailable despite the Promoter’s reasonable endeavors, the Promoter reserves the right to substitute a different prize item of equal or greater value.
